A judge has ruled that Motorola cannot get a ban placed against Microsoft and their Xbox and Windows products. US District Judge James Robart says that Motorola cannot get a ban placed on Microsoft anywhere thus leaving the ultimate decision to the consumer. The notion for the injunction began when Microsoft filed suit against Motorola for not providing its patents for 802.11 wireless and H.264 video standards under the "fair, reasonable and nondiscriminatory" terms. The two went back and forth with the situation escalating to the point where Motorola wanted an injunction against Microsoft's products in Germany.
Motorola won that injunction and the ban was put into place. Now with this coming forward, it seems as if the tables have turned and Microsoft has gained the upper hand in this ongoing battle. This is just a preliminary decision made by Judge Robart. He will render his final verdict sometime in the Spring.

Unless they get damages from Motorola, I don't think that MS has the upper hand, since they lost potential sales in Germany that they will not be able to make up. Granted, PS3 is more popular in much of Europe, but MS still lost out during that ban and may still lose.
