If you were wondering what Mr. Hotz' lawyers had to say in response to this allegation then psx-scene will fill you in... They've obtained the latest batch of court documents; and I quote: Quoted from 117-main.pdf: - Stewart Kellar

Now, SCEA claims that Mr. Hotz must have created a PSN account for the name blickmaniac because the serial number of one of the 4 Playstation Computers that Mr. Hotz purchased-- including 3 Playstation Computers that were purchased used-- was used to register a PSN account. The serial number utilized by SCEA, however, is different from the serial number proffered by Mr. Hotz's attorney. Compare Law Dec., Ex. A, with Kellar Dec., Ex. I. Moreover, such information does not include any information relating to Mr. Hotz.3 The sole way SCEA attempts to demonstrate that blickmaniac is Mr. Hotz is an unauthenticated and hearsay blog posting where an individual attempts to sell an unlocked cell phone -- which is not unusual and major product retailers like Amazon.com sell. Curiously, a search for blickmanic also yields a hearsay blog posting where an individual using the name eepog claims that he is the owner of the blickmanic account and states the PSN account was created by me!!! Kellar Dec., Ex. K. It is important to recognize the dubious nature of creating a PSN account. Just as someone can enter a false name or fake e-mail when entering personal information on a sweepstakes card, someone can enter the same false information when registering for a PSN account. Gillil- and Dec. Ex. A.4 Similarly, an individual can also use a fake serial number or an improperly obtained serial number to create a PSN account.

I see Sony is playing this game bad on purpose. It seems it is desperately trying to lose the cases and the war against jailbreaking, even if this includes loosing against PS3 piracy.
IMO, this is part of its strategy to create lots of revenew. selling hundreds of thousants consoles, which is where the big money comes from. Assuming that the option to download or rent Backups and play pirate games would increase the demand of a now $300 bucks console. I think its similar to what happend to the PS and the PS2.
Imagine, I am now thinking of getting a second PS3 just to play backups and keeping my current one to go online.
Sony has a lot of experience dealing with piracy and I think it has resulted in its benefit, as I said, this is my ignorant opinion.

Only if Sony isn't looking at the long term picture. Consoles generally sell for less than cost at the beginning of their lifecycle, and only turn a profit once R&D has been paid off and manufacturing has been refined some to reduce cost/unit. Which is usually when they have a price cut.

All console manufacturers except Nintendo do this -- they subsidize the console and make money from 1st party games and licensing to third parties. Nintendo turns a profit on console sales from the beginning which is why the Wii was kind of low-spec for it's price point, and why the 3DS costs as much as it does. Sony and Microsoft only turn a profit if you on average buy more than X new games.

I wonder when Geohot's lawyer(s) are going to point out that in order to be bound under the PSN TOS, you actually have to be using the PSN?

It makes no difference if Geohot has PSN account or not. As long as he's not using the hacked console on the PSN, he's NOT violating the TOS. Various quotes from the TOS: It specifically says: "Your continued use of..." followed at the end by "If you accept these terms...", which means even if he does have a PSN account on a "legit" console, Sony can't do shit without proof that he has the PSN account on a jailbroken console. And, even that is iffy. They would have to prove that his jailbroken PS3 has PSN access and then prove that he's using modified software on the console to hack a game. Note, that it says that you can NOT hack games (cheating seemed to be the big thing listed in the 3.56 TOS), but it says nothing about custom firmware. If you catch this Geohot, you're welcome for the extra firepower.

Are you referring to the lawsuit against Jammie Thomas? If so, i'm pretty sure that this is a RIAA lawsuit, not a Sony lawsuit. Sony BMG might be a member of RIAA, but they are far from the only member, so why single out Sony? Sony BMG probably has little to do with SCEA anyway. But the amout of money pr. song that she was sued for is crazy high regardless, i agree to that.

Is the case against Jammie Thomas finished yet by the way? I know that RIAA first won, but the case was taken further. I belive there has been like 3 trials or something in this case, but i dont know if there has been any final verdict yet.

Anyone care to explain how you can use a fake/improperly obtained serial number to create a PSN account before there was any hacking done to the PS3? It reads the serial from the NAND so unless people already knew how to flash it then how is it possible?

Another valid point they all seem to miss is the dns of the ip address SCEA claimed he used. A quick example, lets say you take the city of houston the results of people with ps3 accounts would roll into the thousands. Now on top of that fact if only one of the thousands of people had an unlocked Iphone for sale and pin it to any other of said users of the same domain? Absurd!

The only reason I have a PS3 is because they have great exclusive games that will most likely never end up on PC while the 360 has terrible exclusives and some eventually do end up on PC anyway.
