SCEA and George Hotz Settle

Submitted by greg; April 11, 2011

I'm rather surprised to see geohot and SCEA have settled after all the nonsense, but hey I guess that's how these things work. I'm actually more surprised to read about it on the PlayStation blog. On March 31, Hotz and SCEA reached an agreement where Hotz in part agreed to back off, consenting to a permanent injunction, meaning he cannot hack and share anything PS3 ... ever! Now I wonder if the same applies to other Sony hardware. Hopefully Groklaw can obtain full details of the settlement. From the PlayStation blog:
Sony Computer Entertainment America (SCEA) and George Hotz (Hotz) today announced the settlement of the lawsuit filed by SCEA against Hotz in federal court in San Francisco, California. The parties reached an agreement in principle on March 31, 2011. As part of the settlement, Hotz consented to a permanent injunction. Both parties expressed satisfaction that litigation had been quickly resolved. Sony is glad to put this litigation behind us, said Riley Russell, General Counsel for SCEA. Our motivation for bringing this litigation was to protect our intellectual property and our consumers. We believe this settlement and the permanent injunction achieve this goal. It was never my intention to cause any users trouble or to make piracy easier, said Hotz, Im happy to have the litigation behind me. Hotz was not involved in the recent attacks on Sonys internet services and websites.
Now it's just Sony Vs. OtherOS'ers and Anonymous. - source: blog.us.playstation.com

“Sony is glad to put this litigation behind us,” Since I'm sure it was extremely stressful for Sony. I'm sure Geohotz just laid at home chillin, not worried about this at all. Fuckin fat cat lawyers trying to make Sony seem like the good guy here by doing everyone a favor involved and allowing for a settlement. What a pile of shit. While I can't blame Geohotz he had said he would fight for our rights to modify hardware we own, yet he takes the first out he is given? Doesn't seem like much of a fight to me. I had really hoped this would end with the right for everyone to jailbreak their PS3 legally and without worries.

Quite disappointed considering what he said on his site -

"What if SCEA tries to settle?
Lets just say, I want the settlement terms to include OtherOS on all PS3s and an apology on the PlayStation blog for ever removing it. It'd be good PR for Sony too, lord knows they could use it. I'm also willing to accept a trade, a legit path to homebrew for knowledge of how to stop new firmwares from being decrypted."

- as people may have donated based on that, though I can't say I blame him for wanting this stupid lawsuit to end.

To save ones own ass in place of many Playstation Users, fuck yeah I'd settle too and avoid butt rape. Why rack up on legal bills if backup managers was the first thing that attracted Sony's attention in the first place and the only thing you did was allow other packages to be installed on a system you own?

To be quite honest I just hope the scene sticks to making more brew than focusing on these stupid backup managers that have been nothing but trouble. :P

"Why should I trust you? I do take this whole matter very seriously. Again, it's not about me, I was on the verge of quitting this stuff last June, and I would hate to be the one who sets a reputation for hackers that all a company has to do is sue us and we back down. In fact, I want the opposite reputation set, that the more a company tries to abuse the legal system, the harder we rally back.

What a let down. Here is hoping Graf succeeds where hotz failed. I think that many of us wanted to tell the corporations that we can do what we want with our products. Asking for donations then agreeing to that settlment is rediculous. I would of been happy donating 5x the amount I did and see the courts rule in favor of sony instead of you just giving up.

Maybe geohot did get something from this after all (from his blog):

MX:So you settled according to Sony. Did you live up to this?

"What if SCEA tries to settle?
Lets just say, I want the settlement terms to include OtherOS on all PS3s and an apology on the PlayStation blog for ever removing it. It'd be good PR for Sony too, lord knows they could use it. I'm also willing to accept a trade, a legit path to homebrew for knowledge of how to stop new firmwares from being decrypted."

geohot:@MX The terms of the settlement agreement are "confidential" and the matter requires that they be "confidential".

BricksLamp:What happened? PM, if you need to please.
I'm BRICK, I donated $500 towards your cause.

Please tell me all's well, and we're getting back our OtherOS?

geohot:I will address the donations in a forthcoming post, and I think people will be happy.

@BricksLamp The terms of the settlement agreement are "confidential" and the matter requires that they be "confidential".

It is disappointing that Hotz accepted settlement, especially after everything he's said. Still though, I don't blame him for wanting to end the case, after everything Sony has tried to pull out of their asses. I wouldn't be surprised if Sony pulled something that might have scared him. After all, big corporations will fight dirty if they 'have to'. Anyway, we might as well at least wait to see what Hotz has to say about it before throwing tomatoes at him.

As for Sony, I'm sure they'll get what's coming to them. If Hotz wasn't able to win the fight, maybe someone else will.

I completely agree... All of you that "donated" and sat back and watched as the guy that unlocked a stupid video game system went up to bat for you, should be ashamed. Yeah, he settled... But if you saw any of the legal documents you would have seen that he was fighting a losing battle.

I mean... The judge asked him to physically take back the key he had given out to other hackers... Really? And then her defense was that she wasn't very up to date with the technology and the case.

If that was the judge for my case, I would be getting out too! Ridiculous.

In business things can change quickly. Sony's stock could drop out if a mass number of users start hacking their ps3's. Hacking your ps3 pretty much means you will never buy another game for it again (or very few). So it is sort of stressful for sony.

Very dissapointed in this news to be honest on a few accounts.

Firstly: Geohot stirred up a fervent fever of hate against Sony and their bully boy tactics. He told us that he would do this and that, would never bend over to the man and would fight for what is legally ours ie OtherO, to me it look like Mr Hotz has taken it right up the backside to further his own success maybe by pocketing a nice little earner from Sony in the process.

Secondly: For people that donated to the cause especially people like Brick who donated what is quite a considerable amount of money in this financial climate, I am sure they are feeling quite disgruntled by this news as they believed they had found someone with a bit of backbone to make a stand against the big corporations and fight our corner.

In all its a complete farce, people have been backing Mr Hotz to the hilt, when he has been doing shady lawyer deals behind our backs and yes I mean our backs as WE are the ones that help fund his supposed fight.

Rant over.... not yet

just reading through his plea for money again and what a crock of shit he has spun us.
Why should I care about your personal legal troubles?
You shouldn't. For example, if I was taken to court for sex crimes in Sweden, I would never ask for donations. But this case isn't about me. Clearly I am not being sued because of something I have that Sony wants, I am being sued in order to send a message that Sony is not to be messed with. But if I(and all codefendants likewise) actually win this, we have the power to send a much stronger message back. That consumers have rights, and we aren't afraid to stand up for them.

Why should I trust you? I just saw you trying to rap battle Sony
My attempts at humor aside, I do take this whole matter very seriously. I will be the first person in line on the launch date of the Xperia Play, and itching to get my hands on the Next GEOHOT Project.

Have you figured out why this isn't over, and why I'm not upset at all? I did donate $500.00, after all... and I bought my PS3 with about 30% reasons leaning toward OtherOS (though it didn't have the power I had hoped it would)... don't I have more "right" to complain than most here?

Complete Bullshit. I hate when people talk about stock and how Sony would lose money. They wouldn't lose money, they just wouldn't make the kinda PROFIT they would like, but they'll still make profit. Apple isn't crying are they, and I'm sure you pirate music like the MAJORITY of people out there that own a mp3 player. We as a people pirate movies, software, and music...but games are OFF LIMITS?! Everyone and i mean EVERYONE pirates something in some form of way. If you don't that means you don't own a computer or have the internet. That's just the way it is. It you wanna spend your hard earned $60 to protect Sony's precious stock...then be my guest. Me myself, I could give two shits.

Why do people associate hacking with pirating? I have CFW on my PS3, but that doesn't mean I don't buy my games. I'm all for helping the economy circulate and everything, but why should hacking be anything bad? Especially for those of us who just like having nifty or useful apps, or Linux, on our systems. As for game managers like multiMAN, Gaia, etc, yes, that does have means of generating piracy, but Sony is obviously attacking the wrong people for it. Instead of attacking the people behind the software, why not attack those that are distributing their PS3 isos over the web? They're the real threat, NOT the hackers.

"But everyone is doing it though!" Argument is retarded.

"If you don't that means you don't own a computer or have the internet." What are you even talking about. Not everyone pirates. Quit kidding yourself, piracy is wrong no matter what asshole is doing it. Your not fighting some revolutionary cause by pirating. Your just a lowly thief that will eventually rob jobs of average working people not the CEO's. The "i don't give a shit" attitude is one of a true thief.

Just look at this site. The massive majority of people looking to hack their ps3 is for pirating. Once you can get something for free you never go back. The extra stuff for hacking is great and all but there isn't anything here i have seen that hasn't been done on console already.

I would like to see a n64 and ps1 emu in hd but everyone just cares about getting their "backup" loaders working.

He in fact was the first who jailbreak the PS3, remember the infamous "Hello PS3, Im GeoHot"? Tes Math release some tools but the jig got discovered/leaked long time ago and NOBODY could do crap with it. Also some people here don't understand what a donation means, if you donate $1 for Hotz then you cant nag of what he do with that $1 because was a donation.

If you got your PS3 hacked because of this then be happy and keep playing (waiting for CFW 3.60) and if you upgrade all the way to 3.60 and bitch about it then is your fault, not any devs fault because nobody point a gun at you and force you update your PS3.

Dear Geohot

For years I have followed you, all the way back to some of the original iDevice jailbreaks. And when I heard that you made a jailbreak for the ps3 I was more then excited, and at the first chance I had I installed it. I have been more then happy with your work for all these years. And even in those days when you fought Apple in the court, I was always checking the updates and always rooting for you. To this day, when you were in court battles with Sony, I was always checking here and your blog for updates just waiting for that headline to read, "Geohot wins court battle against Sony" to come across the top news. But now, that day will never come. I hate how much you assured us that you had everything under control, only to bail at the first chance you saw. Since the first day I saw you on the news explaining your iPhone unlock, I wanted to be just like you. I thought of you like a role model, A person that's willing to help others by setting new laws by fighting big corporations just like you previously did with Apple.. Actions speak louder then words, but with this entire ordeal, all you gave us was words. In results, I'm just down right disappointed.

But in the end, I still have hope in you Geohot. Your brilliant, and even though you made mistakes, you still have my respect.

I'm saddened, they must have blackmailed him, or at least secretly offered him money to settle. I mean really, why else would he have given up on this battle?

you do know this has been going on for awhile saying he took the 1st out is wrong it was a battle he can not win but im sure there is more to the settlement then just him not being able to mod sony products cause thats what a settlement is both partys get something out of this

yeah for the most part when they 1st came out with the ps3 they let you put your own os on it and do what ever you wanted for the most part even had a tut on the sony site on how to put a bigger hard drive in your ps3 but now it just seems like they are wanting to be like microsoft and provent people from getting the most out of the system

actualy it was more of there was a bigger risk hacking the xbox 360 not sure about the wii dont have one and dont care about them but i mean im new to the ps3 jailbreaking and everything but from what i can see all you need is a usb stick and the right firmware while with the 360 you got to open it up put in a mod chip and so on and so on and aything you do microsoft will be able to tell while with the ps3 you can fuck it up and im sure if you get some one stupid on the phone you could send it in and get a new one or something dont know im probably just talking out of my ass

As we don't have any details of the settlement yet, we can't be sure that these weren't included... But yeah, not very likely...

Although1! $ony didn't drop the case, they arranged a settlement, which normally means that they both get a little something something. Maybe OtherOS returned? A development platform (although limited) for indie developers? Purely speculation...

Watch Groklaw or wikileaks over the coming week and I'm sure they'll have all the details.

Words are cheap, actions (and lawsuits) are not... However, that said. Do you want to be sued by a gigantic multi-national?

No..? Didn't think so. People are too quick to judge. If you don't know him personally, you don't know what kind of pressure a trial like this puts you under. He had an excellent legal team, and I'm 99% sure that; $ony approached his legal team, with a settlement proposal, George's lawyers came to him and said, "honestly, it's our professional opinion that, this is going to continue for as long as this hypothetical piece of string. Even then it will end in a settlement a few years down the line". Which I think is entirely true.

No one chooses to be a Martyr, usually they are faced wit no alternative option than to die one. I don't blame him at all, this is probably the best outcome, realistically, that could of happened.

If you're bummed about feeling cheated by hotz, donate to graf. 1,000,000 euro's is a lot of 0's... AND HE IS STILL HACKING AWAY, RELEASING, AND WORKING FOR US!!

A few things sir...

They can indeed remove you at any time for any reason. HOWEVER, you can sit outside doing the same thing.

He was also refering to the upcoming anonymous protests... Now, I know someone who actually works in a $ony store in London (oh, btw, they get a fair bit more than minimum wage, they're salespeople, not labourers...), and they are dreading the 16th. Nobody wants to work that shift, holidays are not permitted (unless booked largely in advance) and doctors notes are required if they are sick.

Things like that; fear, the calm before the storm, the unknown about what exactly is going to happen is the only way you can get to company's like $ony.

Dealing with hackers online is one thing, dishing out bans to a bunch of faceless numbers... But when there are a hundred people sitting, chanting, waving signs, all wearing masks outside your place of work, well, that's a little more difficult to deal with... And the police can't do ANYTHING about that so long as it remains peaceful and within protest laws. PEACEFUL PROTEST IS 100% LEGAL ON PUBLIC PROPERTY!!

Do some research, then speak.

xbox == PS3

Except for a few exlusive titles, I can't tell the difference between the two.

I prefer the XBOX controller, and the graphics look the same to me... Plus the kinect is just fricking awesome... Especially if you're a fat fuck like me that isn't fond of the gym.

Hacking leads to custom firmware,
Custom firmware leads to backup managers,
Backup managers leads to piracy,
Piracy leads to... the dark side!

You can't explain to the people who hold vast chunks of your company's shares (which in itself is a palendrome), that, this guy we were sueing is now on our payroll. Just can't happen.

"Apple isn't crying are they, and I'm sure you pirate music"

Apple don't own music. They're not even a record label. They're a mediator that takes a tiny % of millions of sales. A portal, nothing more. It's people like EMI who lose out hard... Oh, and $ony ofc.

Same here. The fact that most multiplatforms are made almost identically for both platforms (save for better textures in some games on PS3) they're practically identical, and personally, I prefer achievements and the 360 controller. That said I love my PS3 :-D

I can bet 90% people hack their console is for pirating games and software.
If you are not being honest, that is fine. no one is going to track you down. People just want to find reason to prove why they do and why it is right.

Pirating is never be right. If you are developer, programmer, you will understand that. If you are not, I hope you children will be that you will feel it at least.

Most people here are young, teenage to may be up to 30. You dont have money, it is ok. Please Dont try to find the reason to protect your pirating. Those have family, how can you have too much time for gaming. Gaming is not you priortized stuff in your life. I myself barely have enough time for gaming. If you have too much time for gaming, go to find better job and pay for the game. Or go to educate yourself better to find better job at least for your family sake. Those said games are too expensive, go to buy older second hand game. You don't need to play new game as soon as it come out. unless you are kid and compare your classmate and neighbors' kid. Although, Sony should charge game less than $50 for new one. same as Xbox. but Wii and 3DS game are more like rip off there.

Those whom donated to Hotz, those have good will or support what he was doing. But if you didn't donate, dont cry like baby. Even if you do, dont complain. Why dont you go to face Sony of any law sue? That is time and $ consuming. And very stressful situation for Hotz. The cost may be up to couple millions. the donation may not be enough for partion of it.

finally, whatever it is. If you want to reply or attack my words, I don't care. I meant. That is pointlessss. look into your heart to find what is wrong and right. I am tired of looking all of this and this is my first post.

No one ever said you didn't own your PS3 or couldn't do whatever they wanted with it. There is an underlying problem with it that everyone seems to ignore. This is Sony vs Geo not Sony vs Everyone who owns a PS3. None of you are doing anything wrong by putting CFW on it the problem was Geo broke international copyright law. If he figured out how to do CFW without bypassing Sony's security they couldn't of said anything.

I think you are missing my point. He said this wasn't about him and that he was planning on fighting the message Sony was trying to send. I also don't blame him for taking the deal. That being said, I think it would be nice if he explained his reasoning for taking the deal. If he isn't allowed to speak about it, I am sure he could tell us that. I think he owes it to anyone who reached into their pocket.

Thank you to the dev's for this. It's nice to play online again. As for the Geohot outcome...I have to admit that I'm feeling let down by the whole thing.I thought he was going to fight for all of our rights.I also thought that he wouldn't take a settlement without the return of the 'OtherOs' feature and apology from Sony.I think alot of people donated on those premises which were fed by George himself...but according to what I've been reading online...he is apparently helping Sony in their fight against piracy...is that why I've read of hackers saying George took a job at Sony to make the PS3 and future consoles unhackable?I don't want to jump the gun...but all this doesn't look good for George and I have to wonder..."what was it all for?"

But to the Dev's whose honor is unquestionable...Thanks for everything!!I have a PS3 that truly 'Does everything',as the box it came in says...and I love it!

And to Sony and anyone who makes deals with them...Was it worth it?

He did exactly what he said.... He fought against them and stood up. He never said he was out for victory. He did what MANY would not, Stand in the face of a mighty corporation with his chin held high to be a symbol of what the hacking community hold dear. I have not once seen him ever say he was going to be a savior. He, in my eyes and I am sure many others, has gone above and beyond the call. He did something many of us wish we could do, something many of us fear to do, something many of us strive to do, and that was standing up for his right of love of knowledge!

I'll agree with the pirating not being right part since I do program (though generally not for money). But saying that 90% hack their consoles to pirate games? What about the 99% that don't?

I personally like "hacking" stuff just for fun or to make improvements or even just to have something to practice with.

Yes, I do like my backup loaders. Why? It means I don't have to run around my room switching disks every other day. With a backup loader, just backup the game once, put it back in the box, put it in storage and never see another scratch on your disks until it is time to change systems.
