Better Business Bureau: BioWare and EA Scammed You!

I'm sure that just about everyone has heard some part of the Mass Effect 3 drama that has been flying around shortly after the game came out last month. Well now the Better Business Bureau (BBB) is involved.  One of the many upset fans of the franchise actually filled a lawsuit with the FCC for false advertising so the BBB asked the question "did BioWare falsely advertise?"  They say "technically, yes they did" and the BBB sited these two instances.

  • Experience the beginning, middle, and end of an emotional story unlike any other, where the decisions you make completely shape your experience and outcome.
  • Along the way, your choices drive powerful outcomes, including relationships with key characters, the fate of entire civilizations, and even radically different ending scenarios.

I'm sure there are a few of you out there wondering how those points could be considered false advertising.  So lets go back to the BBB for a little more insight.

In the first bullet point, where it states the decisions you make completely shape your experience, there is no indecision in that statement.  It is an absolute.  The next statement is not so absolute.  It states your choices drive powerful outcomes.  A consumer would have to very carefully analyze this statement to come to a conclusion that the games outcome is not wholly determined by ones choices.  This statement, really though, is very subject to interpretation.

Thats not false adversing at all:

 

"the decisions you make completely shape your experience":  Well, DUH!  They game wont play itself!  It cant MAKE me shoot a gun at the floor just for kicks, or make me walk backwards in a circle while reloading!  So of COURSE its an absolute!  There was NO false advertsing in that first statement, period.

 

"your choices drive powerful outcomes":  Again, going back to my first statement, of COURSE!  If you do nothing but shoot at the floor all day long, your GOING to end up dead, and I would say thats pretty powerful, to lose so badly.  lol  But if you shoot every enemy in the head, without missing, kill everything, then you WIN, and that ALSO is pretty powerful.  To be able to blow them all away with skill.  And, as with a lot of games, there are multiple endings, which makes the statement TRUE!  In English, "endings" has an "s" on the end, which denotes MULTIPLE.  There are TWO endings to EVERY game!....You all know them....LIFE and DEATH.

 

The BBB is just trying to find a way to poke the finger away from Sony.  Im almost positive Sony is filling the pockets of just about everyone them come across, just to have their way come out on top.  Sony has scammed people for years, and is over-doing ALL of their console security, really for no purpose.  This is just another stab at a smaller company, and they know it.

You're reaching for a rope here and grabbing air.  The first statement you could possibly get away with (though not in the context you mention...) but the second statement has no way,shape, or form of being dismissed.  Life or death?  Really?  That's like telling someone you can read a book... or NOT read it!  It's a totally unique and NEW approach in imagination and context of reading a book!  Assume everything that happens!  Won't work at all. 


The legal system bends, that is true, but not to stupid statements or irrelevant opinions (especially not in today's day and age).  "Radically different ending scenarios". Two options isn't a radically different ending scenario it's a choice whether you sit and restart indefinitely (unless you die and just put the game away forever) or  beat the game with the only ending they placed.  The ending doesn't really change as you constantly end the game in the same way over and over regardless of your choices. 


That little jab at the BBB poking fingers away from Sony is another fabrication.  They had still been in lawsuits over PlayStation 2's faulty DVD drives off of their older systems up to a few years ago when the expected life of said drives was reached. Let alone Sony's lack of security over encryption of highly classified data, and not to mention the possible hundreds of recommendations for improvements and complaints filing out.  The BBB has thousands of people working around the clock with so many different businesses it's only normal for them to take time with their work.

Yes, there is corruption and dirty handing in Sony's business(Same with most big companies).  Yes, Bioware made a game so underwhelming that fans of the series since the beginning are so upset that they are acting out very irrationally. 
Will this succeed?  Probably not since gaming companies hire law firms to shoo away these types of issues.


Who knows, maybe Bioware will pull out the "Alternate Ending DLC" card and this will all be just a horrible nightmare.

Don't sue Bioware, those guys are awesome (I'm from Edmonton and I've been to their studio, really sweet). Sue EA, their pricks.
