Sony Vs. The Hardcores Day #2

Submitted by greg; January 13, 2011

I'm curious how this'll all pan out... I mean, I'm sure Sony can afford some pretty slick shysters, but geohot on the other hand, read his defense (19-main.pdf & 19-1.pdf), and it would seem he and his lawyer(s) know exactly what's up. You can familiarize yourself with the ongoing Hollywood-esque case here. In a quick summary: Sony is crying and going after the hackers who crippled their security (fail0verflow) and exposed all their encryption keys (geohot). It's an interesting DMCA case and courtesy of psx-scene are all the latest supporting court documents from both sides. They make for a good read. I really hope the hackers win this case.

Sony getting their equipment might lead to patching further Custom Firmware.

Well, I suppose this means PS4 will come around the horizon soon then. If Firmware updates won't fix this issue, Sony is in Microsoft's shoes then.
The way I see it, were angering Sony and I'm hoping we just don't get them mad enough to dish out where they make us pay for internet like Microsoft. Guess will just see how far this goes ;)

when will we be able to run backups ??!

has anyone thought about making an app that patchs a game so you can run it from xmb,i know the patching can be done manually but it way over my nooby head, and i think it's the case for a lot of us here

the same(or somewhat similar) app is available to decrypt psp games, patch them and re-encrypt them, and it even works form the xmb of the psp(iso-tool x.xx)

anyway i just want to run wipeout hd fury,if someone could be kind enough to help me?anyway possible?

I don't think were gonna see any backup manager from geo or fail since sony can take action for a backup manager being created. but for now the only thing sony can accuse them of is compromising security of their software which wont really hold up in court cause we purchase the ps3 so we are entitled to do whatever we want with it. the only illegal thing would be having backups of games you don't own and even then u can get around that by saying its for "demo" purposes only. this is gonna be an interesting battle. either sony wants to scare the community by suing the big guys, or they really have something up their sleeve. so far sony is succeeding in their scare tactics. but we should really band together and pick up where the giants left off instead of just waiting for it to come. but so far its been a little hard to follow in their footsteps, they are the best for a reason.

Oh, for God's sake, people, stop asking about backup managers, especially now!

How much common sense does it take? Seriously! Two of the greatest hackers I barely know are in deep legal trouble and all you care about is getting off with $20 worth of games?! It's obvious ANYONE asking for a backup manager, or a way to run .iso's, or a way to do some other discless launch is a pirate. Enough. Seriously, people.

-pants- Okay, on topic now..

I'm no lawyer, but I laughed my face off last night when I read the "Complaint". There's so many loopholes in that document and way too many inaccuracies. Sony obviously has no idea what they're doing.

On a similar token, so far, all the tools released only seem to run if one has the knowledge to compile them. I say, we try to keep it this way. Seeing the comments on previous entries, I like to think it's stopped most pirates in their tracks. Keep things open source (Or at least obfuscated, but not compiled), keep things Linux-based, and I think Sony's safe from any gigantic profit losses.

In short: Sony, find better lawyers or bring OtherOS back in your next update. It certainly can't get any *worse*.. Frankly, all some of us want is a nice octal core CPU to run as a server. Geohot, good luck, not that you need it though. Fail0verflow, I don't know your situation as well as Geohot's, but good luck just the same. Everyone else out there only looking to run some nifty homebrew and rock out with Linux, cheers. Pirates (Or people seeking backup managers), shut it. PSN games and blu-ray are fast enough. I like the vintage feel of handling optical media. If you guys can't get up and put a disc into your PS3's drive, it's no wonder you can't hold a job and pay $20-40 for a game. If you can't afford that, you really shouldn't be playing games in the first place.

Sony will loose. The team hasn't done anything illegal. I would think sony taking away linux. And as for Geohot and Sony's code on his website, I would think unless that particular sequence of hex keys were protected by law (Copywrite) he hasn't done anything either. I wish we could sue sony for something.

Again...Sony is wrong. After analyzing the said affidavit, SCEA has no brains. *First they go the cheap route with their security measures. *Secondly, they COMPLETELY goof up by not using random numbers in a random number security system, smh. Third, they file court papers without actually doing their homework,i.e. Hotz is not bound by SCEA terms of service as he has never had a PSN account(so epic). Next, instead of filing separate suites they go the cheap route again and file 1 suite with multiple defendants which are not even affiliates therefore everyones crimes are different but you accuse them of all the same thing, won’t work. They then proceeded to donate a dollar into Mr. Hotz paypal account to say he extorts money for his “counterfeiting services” not realizing they shot themselves in the foot by “enticing criminal activity”. And lastly, (even though I can go on), They contradict themselves by saying and I qoute from the Declaration in Support pg.5 “Once these devices are in the hands of consumers, the loss of control over SCEA’s copyrighted material is permanent and irreparable.” Now you say your loss is permanent and irreparable but state in other provinces that you can fix this with UPDATES yet file a suite saying this is permanent and irreparable. This is perjury and can cost SCEA the case with just this defense alone. I hate to admit it but SCEA is a very sloppy company. Even in the quality of games. Look at all the noticeable lines on the screen when playing a ps3 game that is also on 360. I hate MS as they are a company that tries to over charge for everything but they are a quality staff,ok enough about those lozers. My point, Sony is sloppy and so is their thinking. SCEA they only fail “Everything”! EIPoDT!

This right here... is the most interesting part of the entire document. ***
Mr. Hotz has never utilized an account with PayPal in connection with any activity relating to the Playstation computer. Affidavit of George Hotz ¶ 7. In fact, Mr. Hotz expressly tells people on his website not to give him donations for his efforts. Even more harmful to Sony’s personal jurisdiction argument, the only evidence put forward of Mr. Hotz’ Paypal account appears to be a transaction initiated by the plaintiff.

If Sony fucks up really bad with this case then hackers will be untouchable for a while and depending how far they take it could also define a more broader list of what we can do with the PS3. Sony, be careful on your scare tactic or you could be put into a similar position like Gravity (Makers of Ragnarok online)........Hopefully.

oh didnt mean to submit so fast... so basically sony tried to "donate" money to him in order to accuse him of accepting money for his projects. I think that right there should be entraptment or something along that nature and deserves a countersuit! Mr. Hotz you need to request impoundment of all SCEA equiptment including usb sticks dvds and other forms of data.

I love how they gave him a dollar haha. I wonder if it counted as a business expense for Sony. More seriously, he got the key using OtherOS I believe.. and in his lawyer's reply to the lawsuit, it says nothing of extortion so I'm assuming that's a legitimate cause they do not have an answer for, unless I missed it when I read the pdf.

And for everyone crying for a backup manager, it'll come at some point. Stop "boycotting" Sony for protecting their property, as stupidly as they choose to do it, and I can support the BM until A) a legitimate way to replace broken/damaged discs fruits and B) when digital copies of games are cheaper than physical copies, because I'm sure bandwidth is much cheaper than transportation, packaging, etc.

i know, even if the machine ruins the game, like the xbox problem where it puts that deep ring around the game, and it is not always the users fault for bumping it, (hasnt happened to me yet but i know it happens) there is nothing you can do except maybe trade the game in to gamestop for like 6 bucks off a new copy. All this talk about paying for the license to play the game not the actual physical disc, but if you lose the disc your license to play the game goes with it. I like the idea of digital copies except, once you buy the game... its yours forever whether you like it or not you couldnt sell or give the game as a gift or handmedown, gamestop and other companys would go out of business. So... backup managers seem to be the best way to go! maybe they should just start issuing cdkeys and not allow to copys of the same cdkey on their network at the sametime and just allow backup managers.

All that I can see happening is Sony failing at suing Geohot (Suing Fail0verflow), in such a way that the court tells Geohot to make sure no piracy happens, because lets face it, the PS3 is now owned by the real owners.

No, you didn't overlook. I read all the pages, and I didn't see it. (Unless I overlooked... haha)

The amount is immaterial... that fact that he received it is what they were trying to prove. On the flip side, now it's more of what they were trying to do.

If I were GeoHot, I'd be counter suing the Hell out of them...

Or releasing what they fear most into the wild...

Actually, in a reverse-basis type of argument, it can actually be said that all the bitching about wanting a BM is just further proof that GeoHot and fail0verflow don't support it. Otherwise, it'd already be released and people wouldn't be wanting it. :P

It's obvious you don't have children...

The SOLE reason I want an ISO loader (or backup manager, or any variation of the same) is so that I DO NOT have to swap discs. My son and I like playing various games on the PS3, namely Little Big Planet. And he does reasonably well to make sure he puts the discs in correctly, but truth be told there are hand-prints aplenty and scratching is inevitable ...

Same thing goes for my movie watching experience at home. I've ripped all of our children's movies and nearly all of our other movies to ISO so that they can be watched via XBMC, and for the same reason. It's not that I'm lazy and cannot afford to buy a new game when I want it, but I refuse to have my hard earned money wasted simply on scratched or broken disc, or disc drives (bd-rom drive failures rates are plenty high).

I understand that some 90% or more of the people that are looking for a backup manager or iso loader are only doing it for the purpose of piracy, but there are still quite a few of us that are looking to protect their investment and to better use the hardware we purchased.

I do agree with one comment you mentioned, the loading 'times' are sufficient from the bd-rom media, but abysmal on the PSP...

I would also love to play all kinds of video formats like mkv natively. WOULD IT BE POSSIBLE...oops a lil loud, to get NTFS or HFS+ support for the ps3 so no file restrictions of 4gb. Forget piracy, I got work to do on alot of legit completely legal things. I mean I support geo and fail all the way but we cant put the brakes on... i mean if you have fear, then just post the stuff anonymously. The community will love you and we can really start using the potential of this machine.... unless the coders want mad patts on the back.... well trust me knowing who you are or not, we still highly appreciate your time and efforts!!!!

Perhaps if Sony would have allowed a little more control of the hardware ie the 400 series lasers that screw up and are scarce, if the board was not keyed to the MOBO then a 410 laser could have been fitted (which are brand new unlike the 400's)
So a nice app allowing the drive lasers type/key to be changed rather than a backup manager would be a good start.
Shame on you SONY for making something that fails in the masses and not supplying brand new parts as replacements.

I could reply to both of you separately, but you're the first commenter I respect so I'll give you a double-sized one.

Thank you for not flaming me! About five seconds after I posted I realized I may have well have just asked for sympathy in /b.

"sonyfails", I *am* in a worse situation (to me, anyway). I roleplay hardcore, but I can't draw and I've never been able to get someone to draw for me. I can't pay for a commission either. Does that give me the right to steal someone else's work? Nope, just gotta make due with what I got, and I've been going strong for almost a decade now.

Does the fact you don't have $20 or your parents won't give you $20 give you the right to steal $20? Nope, it doesn't. Seriously, dude, it's $20. Ask your parents for 50 cents of allowance a day or something, and in a month or so you'll have the $20. It usually takes me a month to stop playing a game I like.

Hopefully, this'll teach you to follow the rule of "waste not, want not". If you tear through a game and only let it last ten hours, then what happens when you're an adult and you're wasting your money with no way to recover?

Before someone replies to me and says "Ohhh but what about pirating/hacking? You don't want to let that evolve into adulthood!", let me explain what the *real* people with balls/big girl panties here are doing. The few of us that aren't trying to cheat our way into a free childhood are trying to open up possibilities. They're exploiting life (the PS3) to its fullest, away from the social norm (Sony tyranny) and onto bigger and better things. Sure, it's not hard. Sure, it has risks, but that's life/hacker scenes. Pirates/15 year old kids who don't give a dang, stop begging. We're not doing this for you, we're doing it for the people who want to help improve reality.

By the way, I learnt to use Linux without a GUI when I was twelve. Cracked my WEP key a week later. Changed to WPA another week later. Just because you're fifteen, doesn't mean you should still be sitting around all day and trying to pirate games. Yes, you're still a kid, but you're three years from being an adult. Get ready, or it's gunna hurt when reality hits you. By the way, I'm seventeen.

Get ready, or it's gunna hurt when reality hits you. By the way, I'm seventeen.

*MODERATORS: Please post *this* comment rather than my previous yet-approved one. That one has a rather nasty typo.

Well...Sony's case is full of holes and they dont seem to be properly considering what theyre doing.
Either way, I hope someone carries on the scene, I want that dang backup manager so much! Im sick of not being able to play games because theyre only released in Japan. *Im looking at you Tales Of Vesperia* >.>

i dont think geohot touched any keys either...maybe he saw them or found them but that doesnt mean he got em or used em...its like seeing a package on bench and whats inside because its open but possible you nevwer touched the contents so therefore theres no authorship like i own this.....so sony has a lot of holes and based off other cases it will be between 6 months and 1 year before its settled...not because cases take that long but sony being retards are gona drag it on...even if geohot is winning just to show this is what you will have to go through also...

the truth is hackers are gonna win this.....heres why....if sony beats geohot and fail someone else will take thier place and continue hacking...now if geohot wins we continue and also sony will be forced to release the ps4 early with new security and prolly more retarded laws about what we can and cant do with thier new system but either way sony not benefitting from beating a young hacker in court,.really what does that do?thats silly its like children in a playground..its not a mature company or good business practice...hackers win both sides

It seems that the hacking community has already won. The keys are out now all we need to do is use the info. We all want BMs for one reason or another but this isn' the place to ask. Go to the latest CFW thread and ask your hearts out. Lets keep this thread for the legal troubles of these guys instead of ruining it! If you all want BMs so badly go code one up, all the hard work has been done.

It's on page 282 (last page) of Document 4..Exhibit DD I believe. It is for $1 to geohot(at)gmail . The Payment Sent Transaction ID # has been blacked out conveniently and proves absolutely nothing regardless.

Even better is that on page 247 of the same document they show a screen shot of Gamefreax.com where they show the damn root key as reported by psx-scene. Which means now the "Private Key" is OFFICIALLY/LEGALLY a PUBLIC KEY because it is in a public document. LOL!

I don't care that it "enables" homebrew I bought my console to use it in a certain way (online gaming and stream movies), now I can't online game because there's cheating. OK, So i will support fail0verflow, but is everyone supporting geohot now? the guy is slimeball,

first he loses other OS for everyone (after he has his iOS crying session and almost fucked up a jailbreak from other teams (pos1on) and then publishes and tries to take credit for fail0verflow`s work by publishing keys first, then basically copies the first CFW PKG installer again looking for credit with a few tweaks and on top of that he offered his services to Sony/MS/Ninty to prevent US the community for being able to run home-brew on future consoles. Why should we support him, what the fuck has he actually done to help the community? as far as i can see he is a liability and seems to attract attention for shit he mainly copies from others and is completely willing to screw us over for cash!

seriously give me one reason we should support him?

Then doesn't because the community CALLED HIS FUCKING ASS OUT FOR LOSING IT FOR US. i agree wwith the lot of you people for being f-ing piss at geohot for what happen with the other os but keep one thing in mind.
for the hack to work in the first place u had to open the system up and connect a few things to the system sony did not have to take out the option for the other os sony just took it out to be a prick to everyone there was no reason for this in the first place sony said they took the other os option so their system couldn't be hack by anyone but guess what its now fully hackable. again people do have a right to be f-ing pissed at geohot for this mess.
p.s. for the guy with the cod6 problem you just suck at the game because if the game was hack it would be all over the internet already noob.

I actually find these legal proceeding more interesting than the jailbreak :) For us older folks this should be something worth following because I have a feeling it's going to set some new precedence either way. For you younger folks this could make or break your future console hacking/emulator/piracy playing days.

A lot of court cases are already confusing to follow when they're are non-technical issues. Well this is going to make those cases look like pre-school math :) Once the tech terminology starts flying I can't imagine any judge being able to follow it unless Bill Gates or Larry Elison are sitting on the bench =)

I can't wait to hear more.

2. cod6 being hacked has nothing to do with cfw as the hack isn't enabled by cfw

3. stop talking crap about geo as most of you will benefit or have benefited from his work. stop crying like little pussies and just appreciate what is given to you as you dont have the brains or the balls to do what they do.

@LilPimpT Why be pissed at geohot? What reason? Because he found a way to get inside? He found the hole? So hence you ridicule him and want to banish him for the pure simple fact that SONY did not know a way to fix things with the security flaw other than REMOVE it all together. You have to dig deeper, geohot did not FORCE sony to do anything. They CHOOSE to do things that are seen only as foolish.

Also for people to call out someone and treat them as an outcast for pure sense of wanting to show their love of computing science (TRUE MEANING OF HACKER HERE) I applaud geohots choice of saying a big FUCK YOU to all who did not sit back and bask in what happened.

Now if you want to blame someone you know who to blame SONY. There is nothing you can say to cover it up. SONY is the one that choose the path to condemn you to locked doors and masked freedoms.

i agree the hacking of COD6 or Mw2 has been around for the longest even before this it isnt recent, there are lots of mod rooms out there that hackers make and sometimes people happen to land on the rooms. Using this recent thing for an excuse to sucking at a game is not going to justify anything for you buddy. Next time you should keep things in the low before opening your mouth and getting facepalm and flame by others that know more than you ^__^

I am starting to think some of these negative comments about geohot are being seeded by Sony's contracted social engineers. They do it in other forums, so I wouldn't be surprised to find employees posing as "dudes" to disrupt geohot's support. Then news websites and reporters unwittingly use said negative comments as proof that the scene is in chaos. Happens a lot in torrent forums for new releases, or so I read a year or so ago. Wouldn't surprise me, that's all.

I think we have the grounds for a suit against SCEA by publishing this as a multimedia computer system and then telling us it is just for gaming with this suit. Also, the hackers being sued should file a countersuit for being provided the tools from Sony for said actions on the system. A ceasation should be requested until they can decide how they brand and sale their hardware. As read in George's defense, the lawyer calls them on the same bs.

facts
1) sony made a fatal error in its security algo.
can this be repaired ? if fail0verflow /geohot can break it i'm sure there are others /sony will find a way to circumvent it..maybe crappier but effective method..nothin is permanent..sony wil have to find a way as its their responsibility..

2) sony took away otherOS (probably cos of geohot + scapegoat)...worst mistake by sony..
who lost ? hackin / homebrew community ..which may be a small % of the entire ps3 userbase.
as a gamer / media centre user i dont give a shit.. m happy runnin linux on desktop.

3) fail0verflow/geohot, indirectly / directly, expose ps3 security flaw to public..
who gains ? hackin / homebrew community.. again gamers don care if they can sign windows media player on their ps3..
bet nothin of any significance is gonna come out on homebrew..maybe few..in the long run not worth the effort..hackers and hardcore programmers will move on to other stuff..

4) geohot stood on the shoulder of giants fail0verflow and continued their work..posted keys..asks for job (who would ever giv himm a job if they know he would expose company secrets if they don give him a hike)..arrogant.immature...fail0verflow didn release the keys showin some responsibility..

personally fail0verflow could have approached sony , exposing the flaw..assisted in patchin it without public disclosure of methods.. made few bucks in the process.. instead messy legal battle..

do these guys really care about security ? would they have posted such flaws of lets say online bankin systems wher they have their own money or gone directly to IT guys.. wit great power comes greater responsibility and maturity on the way these need to be handled..

many countries have gun control for the same reason..creates more risk than actual safety..greater good..

who loses in the long run??
majority of ps3 users probably gamers or those who use it like a media centre like me with more firmware updates / stupid but effective security measures aka steam / more online verification crap, costlier / lesser games ,piracy , psn becomes a charged service..etc etc..

who majorly gains and are jerkin off now...99% pirates, 1% homebrewers..

wat can sony do? act of good will for its majority users..
1)enable other os
2)enable PS2 support.. this is personal..missed out on the entire ps2 game scene
3)officially support homebrew
4)make a better browser ... for gods sake..

being a ps3 user,i for the first time felt dissapointed with these events...

Why is Sony making this a ridiculous big thing with the lawsuits? This lawsuit does nothing more than just add more publicity to this. Besides, most console gamers are idiots and probably don't even know how to use a usb stick to install the firmware anyways.

Hacking things, makes everything better, everybody knows it too, that's why people buy the iPhone, just to jailbreak it. This is why I bought my ps3, just want to enjoy all the good stuff, those people that are complaining, just shut up already. And get on with your life, unless you don't have a life and complain about how other people are better at you, like geohot- hacking is his life and wants people to have the best out of there system.

BEFORE YOU IDIOTS SAY IT HASN'T, IT'S NOT THE HACK DIRECTLY BUT WHAT THE HACK NOW ENABLES, IT NOW ENABLES OTHER PACKAGES TO BE RUN THAT LET CHEATING IN GAME OCCUR

SO STFU BEFORE YOU SAY THE HACK HASN'T DONE THIS, IT HAS and what is more there is proof.

MW2 shows you your "killers" screen for when they killed you, it's FULL of "god mode" words across the screen and the name of the tool they've used.

Look, I am sure most of you know of the useful applications that the Playstation (R) 3 could be used for. Currently, it is used to find cures for cancer, used in clustering for super computing by the Air Force and other organizations, and educational endeavors. Sony took the Linux OS away not because of George Hotz, but because the PS3 in clusters were far superior to servers and super computers for a fraction of the price.

It is the same reason why they removed the "Backwords Compatablity." The Playstation (R) 2 games were outselling Playstation (R) 3 games and to boost sales, they broke (one) of their promises and took out backwards compatibility. Sure the unit itself with B.C. costs more, but they were hoping for a huge net gain on the games which they never saw.

Now everyone here, this is for Computer Science and should be treated as such. George Hotz is not only helping the hacking community, but any organization that wants to bring forth the potential of the Playstaition (3) to solve real life problems.
