I for one will not be buying the new PSP portable ("NGP"). Sony might promise functions in this new device and afterwards take them off (like OtherOS), Sony as a company should not be able to deny us certain properties of OUR devices that we buy. If I payed over 300+ for the PS3, I would want it to have a functions of previous modals (referring the slim to the phat modals).

Sony would do the same for the NGP if we decided to buy it, I say that we make a strike against sony by refusing to buy sony related products and stopping using sony services (Playstation Network - "PSN").

Because Geohot at least has broken US laws, to be honest I don't even think Sony could care less about FailoverFlow as they are in Europe and people only add them because Sony have parts of what they have showed to the world, in the court case against geehot.

Just because you can get someone's account, data, keys etc doesn't mean it's perfectly legal to do so.

Geohotz lawyer at the outset will know this and will know they don't have much to stand on and probably know Geohot will lose but they would be just damage limiters rather than get him out of anything.

I have a theory since geohot was the first to discover the keys so cfw was even possible. They thought if they stopped geohot than he wouldnt be able to legally figure out the new keys in the new 3.56. But guess what?
Not even a 3 hours after the new release someone already figure the new keys. So im guessing new cfw will be, out soon.

I don't agree with all these court cases but in this case I do think Geohot should go down.

Because the PS3 wasn't pirated at all, you could download games but you couldn't play them.

Sony allowed homebrew at the very start but OtherOS got the can because Geohot was using it to help break OtherOS to play pirated games or what ever the deal was at the time.

So Sony removed it because he made a big deal about using OtherOS to break the PS3 firmware.

So have a whinge to your hero Geohot about removing OtherOS for you.

Now people are just pirating stuff all over the place and now due to Geohot other people are using the keys and programs he himself released of his own freewill and gloated about to make CFW that allows people to pirate stuff on the PS3 system.

Now he is in the same boat as he put Sony in, as he's now being sued because other people are using what he has given away for illegal uses.

Its good to know that a device I worked hard for and paid around $1300 (60GB BC Model, NZ$) to get; I can now develop my own software if I choose too. Also, I was under the impression at purchase that the system I brought, I owned and could do whatever I wanted with it. They did not state otherwise at the place of purchase. Actually, it maybe even illegal for them to sell this under my country, since the store that sells it actually doesn't own it in question (selling goods that are not owned by you).

Only the public parts of the keys have been extracted. They're doing a proper job of keeping the secret part secret this time. Which means we can decrypt newer firmwares and packages, but not sign them in a way that newer, official firmwares accept them. Looks like everyone has to decide now whether to go modified firmware forever or stay official forever (or hope for the next exploit).

AFAICT, the whole argument there was that they claimed one of the Does was likely to live in CA, so they had standing to sue in CA. Does that mean that I can simply add an unidentified Doe to any suit I want and move the case to whatever jurisdiction I want to pretend he's in?

More importantly, does this mean that if that particular Doe is discovered not to be in CA that they have no claim to standing in that jurisdiction and would need to throw the case out and start over in an appropriate locale?

oh my wow lots of long winded people here, i do understand everyone's side on the issue. I just wanna say i have respect for geohot and fa1l0verfl0w. I just have a few pointers.. For me I'm all about cfw and backup loaders.. but my case isn't for piracy. Yea I'm running broadband but i live in the middle of nowhere.. Din't always though. I used to live in a big city, I was a lead guitarist in a band. I moved here for my family.. now this is my point: I have 2 children YOUNG children, my use for backup loaders on all my consoles, wii, 360, psp, ps3 is, when you have young children no matter how much you try to take care of your games that you spend 40-60$ on, their gonna either bite the bucket or end up with long load times, due to wear and tear.. if i can backup these title that doesn't happen... as I said I have a broadband connection but my download speed here is only 1.5mb so downloading games takes forever so there's no purpose in it for me... But I do breathe a sigh of relief when i go to play a disc with a massive scratch cuz one of my kids found it and used it as a drink coaster, and I'm able to scroll through my XMB and load the same title and not have to re buy the disc. My fiance loves Mario Party 8 on our wii, but since we bought it my son has put a game+SD card+nickel into the disc drive and turned it on which I had to tear it down and repair it, and it destroyed the wii disc, unfortunately it destroyed the disc :( which means we're gonna have to buy the game again because I didn't have it dumped to my external hdd. I also enjoy being able to run my NES SNES Genesis N64 games all from emu's instead of having all my consoles out attached and a cluttered entertainment center... Which I do still own all the consoles, I still have the Atari2600 that my parents bought before I was born, and remember how the cables would mess up, or dust in the cart would make the games not load or give you weird multi colored flashing screens... It's a headache, but if I were to get busted for backups, and the 5-0 busted in my house checking for originals they are all there... I like to rent games as well, but it doesn't mean I'm gonna rent a bunch of titles and dump them, It's like demo's rent, and if I like the title i'm gonna buy it... and I'll probably back it up... What I do respect out of Dev's though is when they release a title, and you buy it, and the disc has the SDK with it.. Most games that do that give you the ability to modify and remake the title however you wish.. Or companies that make Linux or Android distro's.. it's open source you can download it do what you wish with it, but they give you the option to buy... if I download it and I like it, 9 times out of 10 I'll buy a disc with the distro for later use so I don't have to download it again if I need it.. And my final point is, i think companies that see these young kids with the knowledge to do these things that they should get a certain amount of praise... our education system in the US is going down the toilet, and because of the net, be it forums, tutorials on sites like this, or stolen e-books, the kids are learning, they are becoming rather talented at young ages and that is something to be proud of.. I'm learning the programming languages and how to develop games apps exploits ect... and it's fun, and useful... Kids get better education online anymore than in the classroom which is sad... and on to a final annoying fact... the RIAA and music, if I download music and like it, i buy it, same with movies... I don't want all of my HDD's to be filled with the shit forever... what if I want to install something else, or save photos, home videos, music I've written... But at the same time, I don't want to hear a single on the radio and like it, then buy the record and the other 12 tracks suck balls.. I'd rather download the record, try it out, and if I like it, I'll either rush out and buy it, or hit iTunes.. and as for PSP, a few years ago I had to sell my PSP1000, but I had trouble trying to get cash out of my games,... stores wanted to give me store credit.. I needed the cash.. okay well after the launch of psp GO my fiance bought me one because she knew I loved it... well half my titles aren't on PSN, so my only way to have these titles now, was that I dumped them to ISO/CSO and now that the HEN's/ISO loaders are running, I can play my old titles again.. sorry sony I have respect for you as well but you fisted yourself a little with PSP Go!

That doesn't mean shit dude... People would buy the consoles for the homebrew and extra functionality, not for piracy. They would still buy and play the regular ps3 games... what people don't understand is how little the "pirating" community is in respect to everyone else. A person that pirates would not purchase the game if they couldn't pirate it... they just wouldn't play it. The fact that users would have the ability to run homebrew is what attracts them and gives them a reason to buy the platform.

Despite being on the side of the hackers and owning a hacked console, I've gotta say that you ALL seem to be missing the point which is the reason why Sony is sueing.

Sony has the right to be pissed because we're ruining their business. Enabling homebrew would mean eventually enabling backup loaders meaning we no longer have to buy games from developers. So developers are losing money meaning they don't wanna support the PS3 no more(you can see this effect on the PSP's game library)
and a bad game library means Sony will make less sales on the PS3. So technically we have no right to be mad as we're the ones that are ruining their business. We're the bad guys, not Sony.

Again, I'm just saying that I understand Sony's viewpoints. As for myself, I'm still sided with the hackers :)

The problem is that by failing to update the system lost customers to log on to the PlayStation Network, which is another important feature for the console. New games usually have a need for the latest version of PlayStation software to run.

The result was a lot of angry customers, such as complaining to the Consumer Council. They have now gone through the terms of use for the PlayStation 3, and found that Sony marketing violates the law in Norway. Consequently, they have complained about Sony the Consumer Ombudsman.

most game on the ps3 are violent,not that many good kid friendly games on the ps3. About the PS3 and all the crap surrounding it's updates, they took out Other OS (wich was one major reason for the most of us to buy a PS3) they keep coming out with updates that don't update sh*t, i'm pretty sure there'll be one update someday that will remove the ability to update via USB very soon and new games keep needing those same updates to be played. So If that ability was to ever be removed, if someone that doesn't have their PS3 connected to the internet won't be able to install the newest updates from sony and that being said they won't be able to play any games at all because they will need those same updates to work, making their $400 investment completely useless.
We all bought our PS3 out right, we did not rent them from Sony so it belongs to us completely and we should be free to do with it what ever we feel like (even if it's to throw it agains the wall or something like that).
If you buy a couch for example, you don't see the manufacturer coming to your house and perform a "minor security update" and remove the cushions from it do you?

Good job delegating over a real non issue Sony makes a fortune off of the console market. What's the big deal against geohot? Yes his jailbreak was epic but he DID NOT include a way to play backed up PS3 games from the hard drive, keep that in mind that he left out this feature from his jailbreak release due to piracy. He only allowed you to install signed apps such as emulators and such, which would not hurt PS3 sales. It was the custom firmwares that started rolling out soon after the jailbreak was released that brought upon the ability to play PS3 games from the hard drive, whether it be legit or not. The game managers came from the homebrew community itself, NOT geohot!

I have all the PlayStation consoles and all the PSP's ever made from the beginning until now. I am a Sony fanboy all the way, but even I think they are definitely in the wrong this time around when it comes to geohot vs Sony. I support the homebrew community 1000%!!! You rock! Still not fair that way. Both OtherOS AND access to PSN were features accessible when I first bought my PS3. I don't see why I'd have to choose one or the other now.

First of all, Sony made a HUGE mistake with the security design. How can you use a constant instead of a variable to generate a signature?!?!? That flaw would've been found a lot more earlier if it wasn't for the presence of OtherOS. They should cut the head of the person who was in charge of the PS3 security instead of geohot. Now, when someone finds a vulnerability in Windows, does MS go after that guy?

Also, why is it legal to jailbreak some devices like the iPhone and not the PS3? The end result is the same for both. And by the way, geohot's patch did not allow piracy. Some other guys works like waninkoko did. They designed their CFW with that goal in mind (I presume).
