Because Geohot at least has broken US laws, to be honest I don't even think Sony could care less about FailoverFlow as they are in Europe and people only add them because Sony have parts of what they have showed to the world, in the court case against geehot.
Just because you can get someone's account, data, keys etc doesn't mean it's perfectly legal to do so.
Geohotz lawyer at the outset will know this and will know they don't have much to stand on and probably know Geohot will lose but they would be just damage limiters rather than get him out of anything.
You just know he wouldn't have told his lawyers everything he has done, and with him doing the stupid thing of still having the Key/programs up till right now just proves he's not exactly listening and doing what he's told by his own lawyers.
Even him talking about the court case is a no no because it could give evidence/proof to Sony's side.
He's just a kid who thinks he isn't touchable but that's just him kidding himself, but real life can be a hard hard slap in the face at times.
The reason why the TRO has gone ahead is the DCMA laws require the defending side to prove they didn't break the DMCA laws.

Because the PS3 wasn't pirated at all, you could download games but you couldn't play them.
Sony allowed homebrew at the very start but OtherOS got the can because Geohot was using it to help break OtherOS to play pirated games or what ever the deal was at the time.
So Sony removed it because he made a big deal about using OtherOS to break the PS3 firmware.
So have a whinge to your hero Geohot about removing OtherOS for you.
Now people are just pirating stuff all over the place and now due to Geohot other people are using the keys and programs he himself released of his own freewill and gloated about to make CFW that allows people to pirate stuff on the PS3 system.
Now he is in the same boat as he put Sony in, as he's now being sued because other people are using what he has given away for illegal uses.
He'll now wish he hadn't given the Sony keys and programs to sign programs with sonys own key away on the net.
All that Geohot has done is screw over the PS3 system now the PS3 games will dearer to cover all the piracy on the system, Devs might be turned off the system so the system could/will get less games and that alone screws over every single person who owns a PS3.

OtherOS was the gateway for anyone who wanted to do homebrew you just didn't get access the GFX card that was it the only thing not given under OtherOS.
Yet OtherOS was still hacked wasn't it, at that time Geohot said it was only to get use of the GFX card.

Its good to know that a device I worked hard for and paid around $1300 (60GB BC Model, NZ$) to get; I can now develop my own software if I choose too. Also, I was under the impression at purchase that the system I brought, I owned and could do whatever I wanted with it. They did not state otherwise at the place of purchase. Actually, it maybe even illegal for them to sell this under my country, since the store that sells it actually doesn't own it in question (selling goods that are not owned by you).

Sony has the right to be pissed because we're ruining their business. Enabling homebrew would mean eventually enabling backup loaders meaning we no longer have to buy games from developers. So developers are losing money meaning they don't wanna support the PS3 no more(you can see this effect on the PSP's game library)
and a bad game library means Sony will make less sales on the PS3. So technically we have no right to be mad as we're the ones that are ruining their business. We're the bad guys, not Sony.
Again, I'm just saying that I understand Sony's viewpoints. As for myself, I'm still sided with the hackers :)

I don't use my jailbreaked PS3 for piracy, but most do. I don't know about the US or the rest of the world as a matter of fact, but here in Puerto Rico there's a PS3 jailbreak epidemic (mostly due to how easy it is). Over half of the people I know that have PS3s are already pirating games. You could say that Blockbusters and and other rental stores are doing serious profit at the moment. And this will continue at a rate where almost 100% have their PS3s jailbreaked (I'm just assuming, because everyone I know that has an Iphone has jailbreaked, and around half the people I know have the Iphone 3GS, and are taking advantage of Installous).
The PSP wasn't really hurt that much by piracy because it was hard to install CFW on it, and many people couldn't do it. It's so easy to just install Kmeaw 3.55 on the PS3, then install LV2pkg, then Multiman/Rogero/Gaia and start pirating. I think the SCEA must be freaking out right now.

The Linux / homebrew community can bitch and moan all they like, the people who get hurt in this are the majority of users that just want to play games legitimately (hell, it's a gaming console right?). All of the systems I have owned I bought my games for, until I got bored of them and hacked and ripped games. I bought the PSP-1000 when it first released and bought all my games within the next couple years, then bought a 3000 a couple summers ago just to mess with.
As long as I'm happy with the console and feel it is still a strong piece of technology, I will support it and pay for my games. Right now i love the idea of my PS3 "only doing everything" like homebrew, ripping the PIC1.png's off games, and backing up my games. The first two I was happy using YDL before the April fools disaster.

rock-star games and other games companies are NOT Microsoft selling windows to the hardware market where units of windows are sold to other companies and then on to the public (this is why Microsoft still make alot of profit ,games that stay on the shop shelf (directly because of backup launchers and hacking) go back to the games company publisher and then the games company are in deep shit ,thanks to all the stealing you are only making it worse for everyone else ,low budget games that are made fast with little thought are the next thing for PS3 just like the psp.
I have a psp and i know there are some great new games but that was all because sony convinced a few companies to still develop for psp even when it was dead because of hacking.

When the PlayStation 3 was launched had computer support for users to install and run Linux-based operating systems on the system. This was a much publicized feature, and many PlayStation 3 buyers has said that it was a decisive factor in their choice of console.
In last spring, however, feature removed, via a downloadable "update" to the PlayStation 3 Then, all customers who still wanted to use the function told that they could not install the update. The problem is that by failing to update the system lost customers to log on to the PlayStation Network, which is another important feature for the console. New games usually have a need for the latest version of PlayStation software to run.
- Obvious violations of the Marketing Act
The result was a lot of angry customers, such as complaining to the Consumer Council. They have now gone through the terms of use for the PlayStation 3, and found that Sony marketing violates the law in Norway. Consequently, they have complained about Sony the Consumer Ombudsman.

- Sony gives itself the right to modify or remove features of the game console of their well-being. We consider this as an obvious violation of the Marketing Act and not the least of trust between producer and consumer, "said Director Thomas Nortvedt the Consumer Council on the organization's website.

- When the Sony via the web link to the game console can remove significant properties under the deck that this is an update, so it shows how poorly made the digital consumer actually is.
The Consumer Council's complaint to the Ombudsman, which you can read in its entirety on their website (in pdf format), they write the following:
- Despite the fact that the nature of the products indicate a degree of wiggle room, there must be a limit to what can be considered reasonable changes. After the Consumer Council's view must be conditions permitting changes à la "update 3.21" under recognized pursuant to the Marketing Act.
In Norway, PlayStation products distributed by Nordisk Film Interactive. When we contacted them for comment, we were sent on to their lawyers, who also had something to say.

1/27/2011 Update: Judge Illston has granted the TRO against George Hotz despite the venue issue still being contested by Hotz's attorney. And I'm out of town. Since CMU has a west coast campus in California and is therefore potentially subject to Judge Illston's jurisdiction, I have disabled my mirror until I can get back to Pittsburgh and look more closely at the current state of things.

We should all protest agains this multi-millionaire company that thinks they can do anything by not buying any sony products at all and see if they can survive without the average consumer.
About the PS3 and all the crap surrounding it's updates, they took out Other OS (wich was one major reason for the most of us to buy a PS3) they keep coming out with updates that don't update sh*t, i'm pretty sure there'll be one update someday that will remove the ability to update via USB very soon and new games keep needing those same updates to be played. So If that ability was to ever be removed, if someone that doesn't have their PS3 connected to the internet won't be able to install the newest updates from sony and that being said they won't be able to play any games at all because they will need those same updates to work, making their $400 investment completely useless.
We all bought our PS3 out right, we did not rent them from Sony so it belongs to us completely and we should be free to do with it what ever we feel like (even if it's to throw it agains the wall or something like that).
If you buy a couch for example, you don't see the manufacturer coming to your house and perform a "minor security update" and remove the cushions from it do you?
Enough said, geohot YOU RULE MAN, keep up the great work and I hope you win in court (cause outside the court you've already won when you acomplished what Sony thought was impossible) and I hope Sony has to pay you a BIG BIG lump of money for the inconveniense that they caused you. I hope the judge isn't easely bought and forbidens Sony from coming up with updates that don't do sh*t and makes them not limit the games to a certain firmware version (new games should work even on firmware 1.5).

This is not about hack or piracy. I bought a playstation with another OS function, to use it as a computer --> sony promoted it this way. All gone...
So Sony, FYI, i will install the jailbreak as soon as other OS is avialable again, and I own my "playstation computer" as they call it in court.

This is about Sony removing features from a product and that feature made them make the big bucks with the sales.
When i bought my PS3 it had "Other OS" in it and it should stay that way. I'm sure that if the PS3 didn't have that feature when it 1st came out them people would buy some other console that would be cheaper and was "just a console". I bought my PS3 when it 1st came out for $600 and I bought the PS3 because it had other os. If it wasn't for that I would have bought an Xbox360 wich was $250. Now Sony remove Other OS from my PS3 making it more like the Xbox but $350 more expensive without giving me a chance. I had to update or I would not be able to BUY new games. So do you think that's fair?
Once again, this is not about piracy!!! but I do rrecognise the work of geohot as being outsanding.

I am a Sony fanboy all the way, but even I think they are definitely in the wrong this time around when it comes to geohot vs Sony. I support the homebrew community 1000%!!! You rock! At least for our European law this is complete nonsense. If you bought it you can play games on it, you can smash it with baseball bat, you can open it and you can hack it. And there is nothing Sony can do with that. It's yours.
And for this reason companies like Sony came up with US laws such as DMCA. This does not bring any benefit to people and/or society. This is beneficial only for companies (and lawyers).

Also, why is it legal to jailbreak some devices like the iPhone and not the PS3? The end result is the same for both. And by the way, geohot's patch did not allow piracy. Some other guys works like waninkoko did. They designed their CFW with that goal in mind (I presume).

is prohibited. Technically, even though Geo made something amazing, it is still against the ToS which does make him responsible for releasing the code/keys/etc to everyone. Does anyone actually read the ToS agreements? Of course barely anyone does because it feels like a bunch of nonsense but Sony needs to protect themselves and the third party companies from any illegal activities.
You want to have more titles such as Call of Duty, God of War, Metal Gear, Final Fantasy, etc.? Abide by the rules and we will continue to see great material. You steal from a store and get arrested, you are going to blame the cop for your screwup?

This shit never happened to a lot of the greatest hackers out there, such as Dark Alex, Yoshihiro, and many many others who hacked because they liked the challenge.
I would say GeoHot did most if not all his hacking like a child. "Look, Look everybody look at what I can do."
Hacking is not for immature minded people. I found that out the hard way.
I used to hack my friends gadgets (psp, ipod, GPS) for them but then they always acted like I owed them more. And it gets really bothersome. I see why so many great hackers just up and disappear from the scene.

however; i do believe that piracy is a crime - copying and selling of copyrighted games. however, i do believe that non-commercial sharing of these games is withing the fine lines of justice. it's almost as legitimate as sharing copies with one another during the old eras of cartridges, floppy disks, and the like.
although, i do believe that sony is in the position of advantage. if they really were losing money with the pirates, they could just as easily stop production and distribution of ps3's and games - leaving the pirate community, including their loyal customers at a loss.
i really don't have a say in this situation; however, i do believe that the longer we keep wanting to play games for free, the harder it is for developers to fund extraordinary game developments - thus leaving the gaming community. we have to admit that the impact of piracy(not to sony but to the game developers) nowadays is not the same as it was before. it has become more and more expensive for developers to produce games that would satisfy the ever so hungry demands of gamers. and without funds from game sales, these game developers would just end up being bankrupt - and we could say goodbye to the gaming industry we have today.
as to sony, they also need funds to support further developments in the business. thus if we want to see more developments in the industry, we should still support our sony in their dealings. the only thing i found that was wrong in their part, was taking out linux support in their system. by taking out this support forcefully through an update, they in my opinion, breeched consumer marketing laws, leaving some of their consumer market who would've only bought the system only for such support. with regards to their security updates in securing the system from piracy and isoloaders, this is just fair game. they needed to protect their game developers, they needed to protect their consumers(from cheaters), they needed to protect their system(from console cloners).
this is a very sensitive issue, which can be seen at different perspectives. i'm not saying that i'm right or that anyone is wrong. i'm just saying my point of view in the situation. i, myself, am still very unsure of my own inclination in the situation.
well anyway, good luck to everyone involved in this, to the hackers, to sony, to the game developers, to the consumers! let's all hope this ends well.
