The only evidence it has put forth to prove Mr. Hotz has entered the PSN Agreement is an improperly authenticated screen shot of a PSN Network account with the username Geo1Hotz. Declaration of Gilliland Exh. A. Mr. Hotz does not own or have access to this account. Mr. Hotz does not live in Rhode Island, does not use the name Geo1Hotz which, in contrast to Mr. Hotz?s common handle, utilizes capital letters and a numeral, and Mr. Hotz was not born in 1995 as in the screen grab. Id. Sony further falsely states that Mr. Hotz is reffered to online as „GeoHot.? This is untrue. All exhibits submitted by Sony purport to show that Mr. Hotz goes by the internet name geohot without any capitalized letters or numerals.
In the present case, Sony cannot demonstrate that Mr. Hotz?s activity could even arguably be construed as expressly aimed at California. To the contrary, the sole alleged tortious activity alleged in this action involves Mr. Hotz-- who is located in New Jersey-- purportedly improperly accessing portions of his own Playstation Computer-- which is also located in New Jersey. Sony's primary allegation is that Mr. Hotz violated the circumvention provisions of the Digital Millennium Copyright Act (DMCA) by allegedly circumventing control access to the Playstation Computer. Sony also includes various other inexplicable claims for good measure, including Mr. Hotz violating the Computer Fraud and Abuse Act and the California Computer Crime Law for allegedly "exceeding access" to Mr. Hotz's very own Playstation Computer, as well as for Mr. Hotz purportedly "trespassing" on the very Playstation Computer he lawfully purchased and owns. Sony also alleges that, by engaging in such conduct, Mr. Hotz has breached the PSN TOS (which is actually not applicable to Mr. Hotz as demonstrated above). Nonetheless, this suit centers around the allegation that Mr. Hotz improperly accessed portions of his Playstation Computer.
Sony thinks that an unnamed defendant called Bushing resides in California but this person remains a Doe defendant, is not named as a defendant, and has not been served with process. Further, all evidence put forth by Sony regarding Bushing is improperly authenticated hearsay. This court should not rely on Sony?s speculation of a Does defendant?s place of residence to assert jurisdiction over a nonresident who is actually named with an address that has been identified, in New Jersey. Further evidence in this matter is found primarily on the internet. Contrary to Sony? assertions, most of the physical evidence and Mr. Hotz himself, are located in the state of New Jersey. The bulk of Sony?s claims regard evidence found on Mr. Hotz?s media devices and in Mr. Hotz?s testimony as a witness. Other than those items, the bulk of the evidence Sony puts forth may be found on the internet which is accessible just as easily in New Jersey as in California. Sony relies on the unsubstantiated residency of the unnamed defendant Bushing as a basis for California being the best forum. However, Bushing has not been identified, named, served, or connected with Mr. Hotz in any way that would warrant bringing the only identifiable defendant out to California. If Bushing does exist and can be ascertained at a later date, Sony would have to amend the complaint to properly name him/her which has not occurred. Thus, New Jersey is an alternative forum that exists to provide Sony with adequate relief. If Sony can obtain jurisdiction by merely including a hypothetical defendant by the name of Bushing that may live in California, then any Plaintiff can file suit in California and obtain jurisdiction by adding Bushing as a defendant.Download: Sony Vs. this is the catch.
if your using that feature to hack the security, then yes sony have a right to protect there product and pull the feature out.
you own the ps3, not the software/firmware that comes with it, you have an agreement, sony say you can use it to do this or that, but they do not say or give permission to hack security.

As an example, a TV has firmware on it, as do all major microelectronic components. Your TV, for the sake of argument, lets say a $0ny TV, cannot then send an update to stop that TV receiving Sky broadcasting signals, if, for example, $0ny has an argument with Sky and doesn't want its sets being used to receive it.
It would be irrelivent what $0ny's wishes were, and would be unlawful to do so. This is the same situation we have here with the P$3. Linux was removed, as Sky was in this example, and hackers have made it possible to regain a feature that was sold with the machine.
In terms of firmware being owned forever by $0ny is simply not true. It is integral to the working of the hardware, and therefore is owned by the purchaser.
If what you were saying was true, this case wouldn't be a joke (which is quite clearly is).

When you buy a P$3, and first turn it on, it takes you to the XMB. To sell someone a product, possibly from a store that doesn't have a returns policy, only to ask them to agree to something as soon as they turn it on if they wish to use it is INCREDIBLY illegal.
Not to mention if you purchase something 2nd hand, to which even if the above was legal and did happen, wouldn't apply as a third party would've accepted the hypothetical license. Which is another reason for it's extreme illegality.
Finally, the P$N (PLAY$TATION _NETWORK_) Agreement is exactly what it's name suggests. It is an agreement you make with Sony in regards to solicitated use of their network and servers. It gives $0ny the right to withdraw its NETWORK benefits to you, nothing more, nothing less. It does NOT mean they can find you in breach of it, come to your house, and take your P$3 away from you.
This is exactly what happened with the class lawsuit against the XB0X, they withdrew HDD installation of games, along with Live access. A class action lawsuit ensued, and M$ were found guilty of crippling purchased hardware, and the courts forced them to reinstate that functionality back.

you do not own the software/firmware, when you buy a console your given a right to use it, to settle my point read your sodding manual regarding the software licence in fact another example, GAMES read them they say the same you can/cant do with it.

At the same time, they should only perform partial PSN bans -- lock you out of multiplayer and trophy updates, but not the Store -- it's the only venue left they might get money out of you, and I can honestly see the potential for suit over PSN-bought games and money remaining in the wallet unless they phrased the PSN EULA very carefully.

Any people running cheats should be banned from playing online. From my point of view, you can do whatever you want to your Playstation, and if Sony wants to go after you then so be it, but when you start affecting myself and everybody else playing the game, it's just not right.

Even if Sony somehow manages to lose this case, which I highly doubt, things have changed forever. This one instance of Hotz making his hack public has permanently impacted the way things will be done in the future. It won't be for the better either. Stricter license agreements, harsher penalties, who knows.

If you're pissed about MW2, go cry to Crappy Ward about it. Their lazy programming was the reason PC sales of their installments of the COD franchise were so lowzy, compared to WaW and Black Ops, which sold quite well in comparison.

Why can't games be played the way they were intended? Is it really that difficult? Once you get bored, move onto the next one. If you can't afford it like so many people are complaining about, then too damn bad, get an education and get a real job. I'm sure plenty of your types are still living with mommy and daddy anyway so don't forget to use them as more than just free rent (hey kids it's not a called stereotype because it's wrong ;) )
Again the majority of you are replying to posts which you aren't even reading, making you look like imbeciles. I never said hacking is wrong or should be banned. I said CHEATING on a multiplayer game should result in a multiplayer ban for that console. It will be a tough and expensive lesson. There is no denying (unless you are an epic-level retard) that this firmware hack opened a large hole for cheaters to climb through.
Also I own Black Ops and the multiplayer is not nearly as fun as MW2 which is why I'm still playing MW2. I play Black Ops for Zombies only.
