geohot Moves for Dismissal

It doesn't take a lawyer to know Sony's case against geohot is a joke; the shysters on Sony's side have falsified nonsense, made inane claims, and really it goes on and on... They can't even get geohot's handle right. Now the lawyers backing geohot are asking for a dismissal. Attached below are the latest court documents -- gov.uscourts.cand.235965.4*.pdf. Highlights
The only evidence it has put forth to prove Mr. Hotz has entered the PSN Agreement is an improperly authenticated screen shot of a PSN Network account with the username Geo1Hotz. Declaration of Gilliland Exh. A. Mr. Hotz does not own or have access to this account. Mr. Hotz does not live in Rhode Island, does not use the name Geo1Hotz which, in contrast to Mr. Hotz?s common handle, utilizes capital letters and a numeral, and Mr. Hotz was not born in 1995 as in the screen grab. Id. Sony further falsely states that Mr. Hotz is reffered to online as „GeoHot.? This is untrue. All exhibits submitted by Sony purport to show that Mr. Hotz goes by the internet name geohot without any capitalized letters or numerals.
In the present case, Sony cannot demonstrate that Mr. Hotz?s activity could even arguably be construed as expressly aimed at California. To the contrary, the sole alleged tortious activity alleged in this action involves Mr. Hotz-- who is located in New Jersey-- purportedly improperly accessing portions of his own Playstation Computer-- which is also located in New Jersey. Sony's primary allegation is that Mr. Hotz violated the circumvention provisions of the Digital Millennium Copyright Act (DMCA) by allegedly circumventing control access to the Playstation Computer. Sony also includes various other inexplicable claims for good measure, including Mr. Hotz violating the Computer Fraud and Abuse Act and the California Computer Crime Law for allegedly "exceeding access" to Mr. Hotz's very own Playstation Computer, as well as for Mr. Hotz purportedly "trespassing" on the very Playstation Computer he lawfully purchased and owns. Sony also alleges that, by engaging in such conduct, Mr. Hotz has breached the PSN TOS (which is actually not applicable to Mr. Hotz as demonstrated above). Nonetheless, this suit centers around the allegation that Mr. Hotz improperly accessed portions of his Playstation Computer.
Sony thinks that an unnamed defendant called Bushing resides in California but this person remains a Doe defendant, is not named as a defendant, and has not been served with process. Further, all evidence put forth by Sony regarding Bushing is improperly authenticated hearsay. This court should not rely on Sony?s speculation of a Does defendant?s place of residence to assert jurisdiction over a nonresident who is actually named with an address that has been identified, in New Jersey. Further evidence in this matter is found primarily on the internet. Contrary to Sony? assertions, most of the physical evidence and Mr. Hotz himself, are located in the state of New Jersey. The bulk of Sony?s claims regard evidence found on Mr. Hotz?s media devices and in Mr. Hotz?s testimony as a witness. Other than those items, the bulk of the evidence Sony puts forth may be found on the internet which is accessible just as easily in New Jersey as in California. Sony relies on the unsubstantiated residency of the unnamed defendant Bushing as a basis for California being the best forum. However, Bushing has not been identified, named, served, or connected with Mr. Hotz in any way that would warrant bringing the only identifiable defendant out to California. If Bushing does exist and can be ascertained at a later date, Sony would have to amend the complaint to properly name him/her which has not occurred. Thus, New Jersey is an alternative forum that exists to provide Sony with adequate relief. If Sony can obtain jurisdiction by merely including a hypothetical defendant by the name of Bushing that may live in California, then any Plaintiff can file suit in California and obtain jurisdiction by adding Bushing as a defendant.

Well if sony is claiming their device is a computer, then geo is completely safe, because jailbreaking or hacking a computer you own is completely legal and not a courtworthy discussion. if they claim he violated PSN TOS then again they are mistaken, because it has no rule (as of yet) to not allow people on custom firmware to access it, you just have to access it from a sony approved device or program.

this is the catch.

if your using that feature to hack the security, then yes sony have a right to protect there product and pull the feature out.

you own the ps3, not the software/firmware that comes with it, you have an agreement, sony say you can use it to do this or that, but they do not say or give permission to hack security.

When you purchase hardware, the software (in this case the firmware, which is integral for the hardware working) is sold too, on a permanent license.

As an example, a TV has firmware on it, as do all major microelectronic components. Your TV, for the sake of argument, lets say a $0ny TV, cannot then send an update to stop that TV receiving Sky broadcasting signals, if, for example, $0ny has an argument with Sky and doesn't want its sets being used to receive it.

It would be irrelivent what $0ny's wishes were, and would be unlawful to do so. This is the same situation we have here with the P$3. Linux was removed, as Sky was in this example, and hackers have made it possible to regain a feature that was sold with the machine.

In terms of firmware being owned forever by $0ny is simply not true. It is integral to the working of the hardware, and therefore is owned by the purchaser.

If what you were saying was true, this case wouldn't be a joke (which is quite clearly is).

When you buy a P$3, and first turn it on, it takes you to the XMB. To sell someone a product, possibly from a store that doesn't have a returns policy, only to ask them to agree to something as soon as they turn it on if they wish to use it is INCREDIBLY illegal.

Not to mention if you purchase something 2nd hand, to which even if the above was legal and did happen, wouldn't apply as a third party would've accepted the hypothetical license. Which is another reason for it's extreme illegality.

Finally, the P$N (PLAY$TATION _NETWORK_) Agreement is exactly what it's name suggests. It is an agreement you make with Sony in regards to solicitated use of their network and servers. It gives $0ny the right to withdraw its NETWORK benefits to you, nothing more, nothing less. It does NOT mean they can find you in breach of it, come to your house, and take your P$3 away from you.

This is exactly what happened with the class lawsuit against the XB0X, they withdrew HDD installation of games, along with Live access. A class action lawsuit ensued, and M$ were found guilty of crippling purchased hardware, and the courts forced them to reinstate that functionality back.

Really, this guy is being defended? I can't believe the amount of dirtbags that are in support of this. Have any of you realized the amount of damage that has been done to the reputation of Sony and all games that have been 'molested,' for lack of a better word, by communities like this. MW2, for one, has been completely destroyed by cheaters. At least 75% of game lobbies are littered with cheaters. The game is unplayable at best. I mean, is it really fun to press a button and get constant headshots just by clicking a button? How bad is your lives that you must go around video games cheating. Not only that but I get the most laughs out of the people that are actually cocky about it and think they're so awesome at the game. If you want to cheat, do it in singleplayer so the gaming experience isn't completely ruined for the millions of people playing the game who paid $60. If you want to hack your own damn console, enjoy. No need to release a program for the world to download and destroy multiplayer games. Thankfully newer games aren't affected by this yet but I'm sure one of you loners has enough time on your hands to fuck those games up too. I hope this Hotz queer gets a nice long jail sentence with plenty of fines. If there's one thing Xbox got right, it's the way they handle hackers on their network. Any detection of modified firmware is an instant ban, and cheaters are dealt with as well. I hope you all have your consoles banned from playing online.

Technically, if you patched LV2 in 3.55 using the same technique as patching 3.41, you *do* brick your PS3. That's why it took as long as it did for a stable LV2 patch for 3.55 to come out -- they had to find a way around the additional memory protections.

Personally, I am all for them devising a method to ID modified EBOOTS being used to connect and/or LV2 syscall hacks and systematically ban any player using those from multiplayer games on PSN henceforth. That should cover the majority of cheaters and pirates, and if they don't mess with those using CFWs that enable homebrew while minimizing the ability to pirate from doing so (basically geohot at this point), I'd be ecstatic.

At the same time, they should only perform partial PSN bans -- lock you out of multiplayer and trophy updates, but not the Store -- it's the only venue left they might get money out of you, and I can honestly see the potential for suit over PSN-bought games and money remaining in the wallet unless they phrased the PSN EULA very carefully.

Yes, that's all I would actually want out of this. I could honestly care less what happens to Hotz. What I want, is the PS3 to be 90% cheat-free again. People that are making completely inane arguments about 'Well hacking the iPhone is legal/modding your car is legal' are not even coming close to making a logical point. Hacking your iPhone and modding your car are things that don't affect anybody but yourself. The hack is being used to allow multiplayer cheating to be utilized on the PS3. It ruins the game that millions of people had paid for. Any fun that was associated with the game (and I am just talking at least Modern Warfare, I don't know the extent of the other games that are affected) is gone. If this hack hadn't been used to destroy multiplayer games, then this would have gone unnoticed by a lot of people. I probably would not have even noticed.

Any people running cheats should be banned from playing online. From my point of view, you can do whatever you want to your Playstation, and if Sony wants to go after you then so be it, but when you start affecting myself and everybody else playing the game, it's just not right.

Wow some people are such morons, the problem with cheaters online in MW2 is been around since for ever. It wasn't because geohot completed the job from team Fail0verflow. Their work didn't open up any doors for cheaters in online games(mw2). Those doors have been open for a long time but it wasn't as common as now maybe some one released the privates hacks or they just used YouTube or something called Google. Learn to use them first instead of accusing others that did some thing for our homebrew community.

That's for the cry babies that are complaining about geohots work opening doors that were open way before this recent work of geohot.

ive been everyone this since the beginning,...sony never had a case...thats how foul they are...they paintshopped some photo of a psn account to say its him like he using thier network but made several mistakes in that painshop or if it was a real account but not his they show last resort they are trying anything to get him on just 1 thing....like i said already they will sue but it dont mean they will win...its scare tactic...everyone move on already....everyone knows the laws and rules now even us regular consumers...that shit dont fly no more sorry big companies

OK if any of you knew ANYTHING and actually played the game, you would know that the problem has turned into an epidemic within the past week or two. I never said MW2 was cheat-free, I actually said 90% which for the most part it was. There were rarely any cheaters in the game before this hack was released. Now there's people resetting other people's stats, changing other people's clan tags, creating modded lobbies, changing server cvars, calling killstreaks at will, aimbot, wallhacks, explosive rounds, godmode, everything.

While it was a problem before it has become epidemic after the release of the first CFW. This release destroyed that game completely online-wise. Others will be sure to follow. Nearly nothing good has come out of this CFW so far, people don't need to swap discs anymore great. Then there are some emulators, great, just what we needed after having them on the Xbox 1, the Wii or even *gasp* the PC. The CFW is useless, currently it's only good for cheaters and warez kiddies.

the guy is whining bout how the patch allows ftp server to allow hacking. this was possible in 3.41 fw due to the jb dongles but they were expensive and if you owned a droid then lucky you it might have support for your droid... bottom line is that geo never intended for bm to work on his.... he even stated it when his cfw was released! but people are blind to the truth.

Lets be honest, lossing other os had nothing to do with the ps3 getting hack. The facts is no one had been able to exploit the system until 3.41 other os was lost I think in update 3.21 and lets be honest how many people really used other os. If you buy a game console to run linux there is something wrong with you. I dont think the majority of ps3 owners said im going to buy a ps3 because I can run linux. The problem, is that when you use shit against the way it was intended, the floodgates open to let in a bunch of scumbags that ruin it for everybody else. Even if Hotz's hack had good intentions, it was completely smashed to shit by worthless cheaters. Why is it always somebody's mission to hack into something? If you have ideas for functions you'd like to see, form some kind of forum/community and voice your opinions. While those opinions may fall on deaf ears when talking to a giant corporation like Sony, feel free to create a market for something new. In the end, there's always a reason why the PS3 was made the way it was.

Even if Sony somehow manages to lose this case, which I highly doubt, things have changed forever. This one instance of Hotz making his hack public has permanently impacted the way things will be done in the future. It won't be for the better either. Stricter license agreements, harsher penalties, who knows.

If you did your research, you'd know that Infinity Ward released a statement which said, "We did not implement any hacker security into our code. We left this to the console to implement. Companies like TreyArc have however implemented preventions in their code to help deter hacking of their games".

If you're pissed about MW2, go cry to Crappy Ward about it. Their lazy programming was the reason PC sales of their installments of the COD franchise were so lowzy, compared to WaW and Black Ops, which sold quite well in comparison.

THIS IS A CRAPPY DEVELOPERS FAULT... PLAY BLACK OPS AND SEE IF YOU ENCOUNTER THIS ISSUE... NO YOU DON'T..? THAT'S BECAUSE THEY MADE AN EFFORT AND DIDN'T TAKE THE LAZY ROUTE AND RELY ON OTHERS FOR THEIR PLAYERS ENJOYMENT!!

Luckily Infinity Ward will never again publish a COD game, so you're safe from now on from shit developers... at least in this franchise.

To the person above who went on a MAD rant about MW2 and Piracy etc etc...DUDE...FUCK YOU. i mean seriously FUCK YOU. U live in the US prolly or some place where the PS3 is affordable to you and the games are super affordable as well...what about places where there is no PSN available or where the games are imported and are super expensive?...what should we do? not play games at all? I come from pakistan and over here the PS3 is sold but the games are imported and cost over a 100$ sometimes (newer titles). and i cannot afford them. i donot hack nor do i play on the PSN but i play games, and i need a backup manager cause i rent my games or sometimes borrow from friends.and they do the same....so it doesnt mean that we cheat..pirate yes maybe..but what choice do we have?...buy super expensive games, whose revenue wont even goto the devs? i choose to take the lesser of two evils.

I love how tons of people blame cfw for cheating...ha OH xbox is so much more secure.....NOT! it has modded firmware as well but there's also the jtag 360's so live isnt that secure. I know quite a few users who still run on live with flashed drives! however the reason i like modding consoles is quite simply a dream of a console that would play every game ever!! where you could play mario,sonic, bonk, crash,gears of war, god of war,killzone,fo rza...etc, Why must we as gamers have to choose a console? there should be an ultimate console and the hacking community and the coders and the modders make your wii's,ps3's and xboxes do what i could of only imagined as a kid. I understand computers and cell phones and other hardware can do this but it's not the same. I personally buy games i like and the ones i don't like i forget about.But quite simply i would love an n64 emulator on the ps3 so i can play conker's bad fur day. and then switch over to nes and etc. In due time this will hopefully happen. and all i can say to you skeptics if you don't like it go buy a fuckin gameboy!

sony's gonna loose. the owners of ROCK, the iphone app which was an alternate to cydia talked to congress, went against apple, and WON in a case against allowing a 3rd party app to be made and ran on a phone due to the fact that the device belongs to you and its anyones choice of what to do with it. exept pirating. :)

I'm well aware of that fact. IW relied on the security of the PS3 itself for protection. That does not absolve the fact that Hotz created a monster. Obviously a stupid idea to not have additional security, but why should it be absolutely necessary to go so crazy with game security? In a normal society I don't think you'd have to deal with these kids that are so bad at playing video games, they must cheat their way on top of the leaderboards like it's some kind of accomplishment.

Why can't games be played the way they were intended? Is it really that difficult? Once you get bored, move onto the next one. If you can't afford it like so many people are complaining about, then too damn bad, get an education and get a real job. I'm sure plenty of your types are still living with mommy and daddy anyway so don't forget to use them as more than just free rent (hey kids it's not a called stereotype because it's wrong ;) )

Again the majority of you are replying to posts which you aren't even reading, making you look like imbeciles. I never said hacking is wrong or should be banned. I said CHEATING on a multiplayer game should result in a multiplayer ban for that console. It will be a tough and expensive lesson. There is no denying (unless you are an epic-level retard) that this firmware hack opened a large hole for cheaters to climb through.

Also I own Black Ops and the multiplayer is not nearly as fun as MW2 which is why I'm still playing MW2. I play Black Ops for Zombies only.
