Class Action Tells Cali Gamestops To Warn About Used Games

We all hear about how publishers are restricting the flexibility of used games these days. Even the upcoming next gen PS4 and Xbox 720 consoles are rumored to not even deal with used games. Things take a turn when people go to court.

In the class action lawsuit bought to GameStop (all those in California) by law firm Baron & Budd, they claim that the retailer was "misleading customers and attempting to maximize profits by buying used games at a fraction of their costs and jacking up their prices "without paying any royalties to video game publishers or developers."

Under the terms of the lawsuit, the affected GameStop stores are required to put visual warnings on used games that have one time use online passes (EEEE AAAAA!) and DLC. The ruling also applies to the online store as well.

When you think about it, it's nice to have the warning but is it necessary? We buy DLC online all the time from retailers such as Amazon. They deliever the DLC via a code. Now, that code entitles one download for you and nobody else, unless you repurchase it again. Do you see where I'm going with this?

I'm pissed off at the publishers not retailers. When you purchase a used iPhone, Apple really doesn't make any profit on that transaction. Thats true. But the old owner probably purhcased a new phone which did make money for the Apple or for any other brand. Same applies for games. When I purchase a used game, publishers don't receive any money from that transaction. But when I sell games I have purhcased new I use all that money on games.

Putting a stop to the second hand market woun't generate more money for the game industry in general. It only means that instead of purchasing 5 new games and 15 used games a year I will purchase 6 new games and a lot of games don't have online players at all. Offcouse FIFA and COD etc don't have to worry, they have decent amount on players anyway. But there are a lot of games that I would never purchase new. And if second hand market dissappears that really means that those games should never work on online part either - there will not be enough players. This has happened even now, when we do have used games market.

this should not be allowed. i have had this with a few second hand PC games i have bought, its in the smallest print ever that its a one account code surely if you buy something you should have the right to sell it on. just the big companys squeezing the general public for every penny we have got. so i take it this means bye bye to renting games!!!!!

this is beyond ridiculous. this sort of bullying behavior should be illegal.

second hand sales are a major part of the industry. it keeps the flow going.

now i will just wait for major sales before purchase.

 

heck most of my recent games have been indie games anyway.

 

first online registrations, then DLC and now this!

Game Stop is known for giving as little as possible for a game and reselling it as close to the price of new game. They are a rip offs.  There have been times I've gone in, and they only wanted to give me $1.00 dollar for a game, so they can resell it for $35 or $40..  They need to be sued, and I hope they go out of business.

I'm guessing the Gamestop employee held a gun to your head and forced you to accept the dollar. If you don't like what Gamestop offers then pick another option like friends, craigslist, etc.
