SCEA Files Motion to Dismiss "OtherOS" Class Action Again

Submitted by greg; April 03, 2011

Sony's removal of OtherOS sure has opened up a can of worms... Not only is geohot in the hot seat, Sony themselves have been battling a class action lawsuit where the plaintiffs are suing SCEA for the unwarranted removal of said feature. The suit has been going on for a while and Sony has once already filed a motion to dismiss, which was partially granted; however, the plaintiffs were able to refile their claims. Well, weeks later -- claims refiled, and the grokkers at Groklaw again have the updates; Sony of course is asking that the refiled complaint be tossed out. Not only that, in a February 9th hearing, Sony asked the judge to grant them access to the plaintiffs' hard drives because ... get this ... if they are Linux users then SCEA suspects they're part of a hacking conspiracy. Haha! The fun doesn't stop there; I suggest you get informed by reading (or sifting) through the full article at Groklaw.

I bought the #@$#^% hardware. I will do with it as I @#$#@ please.
Hacking conspiracy? Sony can eat a d!ck. I'm never buying another product from them again.

I didn't purchase the hardware to have Sony lord over it. If I don't want their software I have the right to tell them to gtfo. Never signed any agreement at purchase accepting Sony as my lord and savior.

I hope they have to give it back, its funny how they think they can just get away with taking away that feature. At least back to the phatties, I mean, they can't expect the court to allow that motion or else the court sucks...

well i dont even own a ps3 but i do use linux well try to learn..
what i dont understand is if sony want to call linux users hackers then they must support hacking to have included otheros in the 1st place! so they really havnt thought that one over lol

this is just because of what hotz did using otheros and sony has no right to remove it because of that! if they dont like it then fix it so it cant be repeated like what any other company would do.. and if it cant be fixed then tuff for them move on to ps4

the fact is it doesnt matter if hackers use otheros if just one customer isnt a hacker that person doesnt deserve to be treated as such so unless sony can prove every otheros user is a hacker they need to stop this bullshit that just makes them look like a spoiled child trying to run a company its almost as if sony sees the "law" as a bunch of retards that will do whatever they please once the work hacker is said

Its veeeery, veeeeery simple: linux is a hacker os -> for sony!! The stupid company has much money from their customer and don't know what to do with the money. I think they said: oohhh maaaaann loook tehhh moneeeeeyyyy.. waaaht shouuuld we dooo with them? Ahhh, we should sue some hackooorrzzz. Yeaaaahhhhhhh. Thats cool and funnyyyy.

Btw: ngp is a piece of sh!t. If u buy it, u just lost ur freedom.

promising to be a piece of shit.
it will have almost no features like the ps3 and psp, it will have a shitty OS, it will take forever to hack unless sony loses its legal battles pretty quick. then once it gets hacked you can say goodbye to any features that sony thinks might have made it vulnerable like using a sd card or having a usb port or maybe even being able to turn it on. then even after all the above it will still have shitty games and no third party support just like the 4 psps or was it 5 psps, idk i quit counting after the second piece of shit.

Yes Eric, you are a hacker/co-conspirator and an illegal trafficker of source code. =D If Sony gets its way you will be given the chair, along with anyone else that is found with Linux or home-brew.

So since Sony had the OtherOS on their systems before we did, are they co-conspirators?

Technically, Sony lost TONS of money, and pissed us hackers off, all because they removed OtherOS. Its not like they were loosing money when they kept it... Why remove it? The fools.

Holy shit Im gonna uninstall Linux form my PC I wouldn't want M$ to get any bright ideas. lol

Sony can suck a dick I have 2 PS3 and one I got to hack because the POS was yellow lighted at the time. so I reflowed it added cooling mods (Cooling Fail on Sony's part) and hacked it. Everyday of my life I am glad I hacked it too. The really fucked up thing is I use it to test out some code I have written and also use it to try out some games. I actually have quite an extensive collection of games I have bought based on playing it on the hacked one and liking it.

sad thing is most people ended up hacking their PS3 just to spite Sony. I have to agree though removal of the OtherOS was a dirty move and it just isnt right to remove a feature people paid for when they bought their PS3.

Here's a good question for you: How the fuck is SCEA still allowed to battle Geohot over his supposed PSN account if SCEA is no longer in control of PSN access? ;-) And in response to this issue: That's bullshit. How are they going to try to confiscate something that people are obviously legitimately using? It's one thing to have Sony bitching about more current firmware, but whenever they forcefully made users choose between OtherOS and PSN like 45 revisions ago, people choosing to stay with legitimate OtherOS shouldn't even remotely be allowed to be the target of Sony's raging on the modding community. I mean, it's not like they're allowed to even run new BDs because "There is a system update". In any event, I'm done ranting now.
