Since March 2011, first amended complaint, there has not been much news regarding the class action lawsuit brough against Sony for the removal of OtherOS. Today news came to me regarding an updated transcript bringing further information about the case.
Reading over at Groklaw most of the back and forth arguments revolve around the "express warranty" and that OtherOS was not advertised on the box. Sony's attempt to wiggle their way out of this with all sorts of legal technicalities will only bring further anger by their disgruntled consumers. Many of which swear to never buy a Sony product again.

even if they restore official OtherOS from Sony, hackers won't stop.
Unless of course they give us the exact same functionality that
OtherOS++ has. OtherOS++ is ++ for a reason. It's not the horribly
gimped piece of shit that Sony's OtherOS is. It has entire access to the
whole system. So unless Sony make an official OtherOS++ that allows
full hardware access, people will still use hacked PS3's for homebrew
and the like. As OtherOS++ is far superior to Sony's version. It's a
night and day difference. You get access to all the SPU's (and PPU
IIRC), plus the RSX (but requires driver.) Where as Sony's version only
allowed basic access to RSX IIRC and one or two SPU's or maybe it was
just the PPU. Either way it was horribly, horribly gimped.
